Legal Question in Criminal Law in Illinois
Grounds for Appeal?
Defendant was convicted of Residential Burglary following a bench trial. Defendant was unaware of his right to testify.
The trial court failed to independently inquire whether defendant wished to testify.

Re: Grounds for Appeal?
In my opinion, this is grounds for an appeal, but the person needs to act quickly to file a notice of appeal. He/she has only 30 days from the date of the conviction to file the notice of appeal. Time is definitely of the essence. These appeals are not easy and they require very extensive research and time. Will be happy to discuss this further and in more detail.
