Legal Question in Criminal Law in Illinois
Hello last night my brother was arrested for soliutation of a prostitute in Illinois. He has never been in trouble with the law in any shape or form. What's the worst that could happen to him ? He was told a fine and it wouldn't go on his record according to the arresting officer is this true

First of all, your brother should hire an experienced criminal defense lawyer. Why would he take legal advice from a cop? The cop didn't go to law school, and practicing law without a license is a felony in Illinois. A fine without a sentence of supervision is a conviction and will be on his record permanently. A defense lawyer could negotiate a sentence of supervision. Then 3 years after the sentence of supervision is over, he can clear his record as long as he has no other convictions. To do this he must file a petition to expunge. The supervision order does not automatically expunge itself. My advice is NEVER take legal advice from someone who not only does not have a law license, but just arrested you. His interest is opposite of your brother's.
