Legal Question in Criminal Law in Illinois

Twelve years ago I was charged with retail theft ( young and dumb--took a sweater from a department store with a friend), my first offense and it was a misdemeanor. I was given 40 hours of community service and supervision for 12 months. Early last year I attempted to exspounge this charge and discovered it may not even be on my record. I took the advice of the packet from the county clerks' office and did a background check on myself. My criminal record showed nothing. Currently I may have a bank do a background on me for employment purposes. And I was told during the interview that they do fingerprinting check and a more extensive background check due to them being a bank. Will this show on my record? Or once it's off it's gone?

Whether your case shows up in a criminal database will depend on which database is being searched. What county was your case heard in? Whether the arrest shows up will depend on the scope of the search.

If the bank performs a county search (cook for example), the arrest may not show up, but if an FBI search is performed, the arrest may show up.

if you were arrested by the chicago police department, get your arrest record from them at 4770 s. kedzie, in chicago. if arrested by another police department, go to that police department and get a copy of the arrest report and go to the clerk of the circuit court in the county you were arrested and get a certified copy of the final disposition. if you have more questions, i can be reached at 312-372-5600.
