Legal Question in Criminal Law in Illinois
Two weeks ago, I believe that my house was broken into by my 22year old next door neighbor and a 13 year old during the night. I had heard their voices in my bedroom and felt myself being moved. I started to wake up but suddenly went into a deep sleep where I did not hear or was aware of anything. The other night I heard the 22 y/o brother yelling at him for drugging me and letting the teen have sex with me. I also heard some teens yelling about drugging and assault. Since I didn't see them in my bedroom and couldn't remember any details of an assault, I didn't file a police report or do a rape exam. Can I open a case with the police with lack of evidence? It is very possible that some neighbors who know the teen were told all the details of the assault. I don't want to go through a lot of court dates and expenses for an attorney to have the case dismissed.

Only the police department can tell you if they have enough evidence for a criminal case. Additionally, if you are the complaining witness in a criminal case, you do not hire an attorney, the State's Attorney's office represents you and the people of the State of Illinois.
