Adoption

I live in Idaho and the mother of the baby Im trying to adopt is in prison in Illinois. Her family can not take care of the baby and would like us to adopt her openly and she did to up until she decided she wanted to keep even theough she has no one to take care of her and she will be be in prison for at least another 9 months to 7 yrs? What rights does she have to keep her and do we have a chance of adopting her if she ends up in the system

Well, I am not sure your relationship to the child, so I cannot be as helpful as I would like to be. If you are the father, then its a pretty strait-forward custody issue, and I am confident you would end up fine. If you are the father's parents, then you will have a heavier burden to show its in the best interest of the child, but your situation sounds pretty good even then. These cases are very fact dependent, and I would need to know what is going on with the father. Also, how old is the child. How often do you see him/her. Lots of questions in these cases.
