Legal Question in Family Law in Illinois
getting a bill for college
My husband and I pay 80% of step-daughters college expenses. She and her mother refuse to give us a current copy of the bill because it shows grant money on it and she contends that is her money and we should pay 80% of the ORIGINAL bill as if the grant $ did not exist. Should we get an attorney now and try to get a copy of the bill (the school will only release one to the student unless there is a court order) or should we wait for her to take us to court? I do not want to be non-compliant with the divorce decree. The bill is due Oct. 7. Should we pursue this, or wait for her?

I don't know what the divorce decree states about your husband's contribution to his daughter's tuition bill. I would need to know that. then I could advise you whether to hire a lawyer. Please call me. 773-237-3516

Since you assume you will be taken to court to defend against a claim you are not paying, why not go to the court first and obtain an order to allow you a copy of the bill. To paraphrase Mr. Zuganelis, the language of the divorce decree is important. Usually, "expenses" would refer to what is owed, not what is paid through a third party. But the language of the decree will control this situation. Best wishes.
