If a child is in the dcfs system can they legally take the child from the mother who has custody if she doesn't comply with what she is suppose to do.

Depending on the circumstances for the DCFS having temporary custody or some control over the child's welfare, the DCFS can ask a court for such custody and the restriction or removal of parental rights. Such actions are part of its responsibility where a child's care and support are adversely affected those having parental rights and responsibilities.
