Legal Question in Family Law in Illinois
My eldest daughter by deceit and lies got to be awarded guardian of my youngest daughter. I retained an attorney and he filed a motion to vacate the judgment since I was not at the hearing. Then he calls and says he is dismissing from the case since I was at the hearing. I was but after the hearing ended. I arrived there at 10:30 the hearing was set for 10:00 am. my car broke down and I had to take a cab. When I arrived at the court and went upstairs the judge was not at his bench and my eldest and her attorney were just standing outside the courtroom So I like a foul went into the courtroom and asked to speak to the judge he came out and explained that the next date was set for Oct 5 and that he ruled already. So the attorney I retained asked to be dismissed after I paid him over $3000 and he did nothing. My eldest daughter issued a petition against me saying I was incompetent that was not released until Oct 15, Since that time I have been trying to get the law firm to submit the motion. Then the law firm dismisses himself. I can't believe this. What can I do?

If you had told the lawyer you were not there, but if fact you were - even late - you misrepresented the facts to your attorney. They prepared a motion based upon what you told them. It was not true, as you were there. They have no choice but to withdraw as your attorney. An attorney charges by the hour. It may well be your $ is used up. It never pays to not tell the truth and the whole truth to your attorney.
