Legal Question in Family Law in Illinois

My fiancee and I were wondering, she has a 9 yr old daughter whose father never comes to see her and keeps trying to get out of paying his child support. He never went and signed the birth certificate and I do believe he wants to sign his rights over. Now my question is if I was to sign the birth certificate, does he still have legal rights to her? And if so how do we go about getting him out of the picture?

you should consider adopting the child. with an adoption, the parental rights of the biological parent is terminated and you are allowed to adopt; however, since the biological father has never been declared to be the legal father, it is questionable whether he has any rights. nonetheless, with an adoption, he may still be entitled to be notified of the adoption. if you have any questions, i can be reached at 312-372-5600.
