how do i file a motion to remove my son from the state of IL to MO? I live 15 minutes from St louis and work in south county and would like to move there and would like to know how to file a motion to remove my son from the state. You need to write up a document which you will title Petition to Remove. You obtain a court date from the clerk of the court of the court where the custody judgment was entered or where it is registered, and send a copy of your Petition and the Notice of Motion to the mother. Eventually the judge will rule on your Petition. There may be a filing fee for the motion.
