Legal Question in Family Law in Illinois

I filed for divorce in 2002, but my husband moved into my house in 2006; we did not get along; so i retained a new divorce attorney who filed for divorce where he filed the new case as parties have not previously filed for divorce. So no one checked but my old divorce case was and still is active. so now i have two active divorce cases; what can I do? Should i report the attorney to the ARDC for negligence? Which divorce case the first or second will the court go by? Can I ask the court to consolidate the cases?

Why would you report the attorney for negligence? Why dont you point out his mistake and ask him not to charge you for the new filing fee. I suspect that since you reconciled for a while, that the initial petition in the first case would have needed to be modified anyway. Talk to the attorney who knows your case what would be the best strategy as there are too many facts etc not disclosed here for anyone to be able to give you accurate advice. Good luck.
