Legal Question in Family Law in Illinois

guardianship

Our drug addicted daughter is currently being held for failure to appear warrants on driving without a license. She says if we bail her out she will sign over her kids,age16,11, and 5. they have lived with us off and on their whole life. her current husband the father of the 5year old is a drug addict convicted felon.I have a complaint with DCFS,but they have not made contact yet. Can we get custody in some form and is it possible to assume the daughters legal rights in regard to the 11 year old daughter, she shares legal custody with her former husband?I know this may be hard to follow but we need direction. What steps do we need to take, we want to try and keep the three kids together, but the 11year olds father may try and take physical custody if he becomes aware of the current situation.

Re: guardianship

Seek the help of an attorney. You may have difficulty keeping the 11 year old since he does have a father who would want custody. There could be a visitation schedule worked out, though. Please call for an appointment.
