Since my husband has homestead rights, will a signed "contract" stating that he will move out under certain circumstances hold up to police or a court of law?

It depends on the contract. If the document is legally sufficient and he has breached its terms,then you can seek enforcement from a court. The police will not involved in your civil dispute.
