Legal Question in Family Law in Illinois

I am a non-custodial father. My ex is trying to have me thrown in jail again for the third time, for being just over 3000 dollars behind in child support.I have always tried to keep up but I am unemployed have no drivers liscence and a bad back.I look for work everyday but can't seem to find a job.I have been paying what I can afford at least once a month through the Illinois State dispersment unit.So it is not like I have refused to pay anything.I thought if I was at least paying what I can now, until I get a job and can pay more, that I would be safe from being thrown in jail. This must not be the case since I recieved an appear in court for a contempt charge.I don't know what else I can do to show that I want to be caught up but just can't until I get a job. Please help, 1 month away from jail. Steve

You need to get all of your evidence together in proper form to be admited into evidence by the court at trial to show that you are not intentionally refusing to pay the money but are in fact doing everythig you can. An attorney would be a great deal of help in your staying out of jail, but you may not be able to afford and attorney under your current circumstances.
