Private Calls & Custody

My brother went to court today to try to get partial custody of his child. The judge locked him up because the baby's mother said he had been calling her private and harrassing her and she has it recorded, but the thing is that the only reason he was calling her was because she kept calling him private and leaving stupid messages which he did not keep, not thinking she was going to take it to the extreme of getting him locked up. She will not let him see his child at all for no reason and now he is locked up. Does he have any rights to this child and is it right that he is locked up right now for going to court to try to see his child?

I'd like to hear more about the situation. If he's the father of this child he has rights such as visitation. In the family law court the only thing a judge can put someone in jail for is "contempt of court." This can be many things including failing to pay child support. Tell me more about the situation...it sounds like unpaid child support to me.
