Legal Question in Family Law in Illinois
I am representing myself (Pro Se) in a child custody matter. My ex, after 7 years, decided to come after me for residential custody of my 8 year old - He has gotten married over the last 2 years and realized he would be saving money. As such, since we have been unable to harmoniously co-parent together, and there have been numerous documented cases of abuse and neglect on my ex and his wife's part, I choose to Petition from Joint Custody to Sole Custody - based upon factual events. Can opposing council choose to strike my petition since he petitioned first?
Please advise.
