Legal Question in Family Law in Illinois

i have sole custody of my son and im moving to CA to live in ill right and now my baby father want to take me to court he dose not pay child support and did not sign the bc and have been in and out of my son life my son is only four what can i do or should do he dose not have a lawyer he doing this on his on do i have a better chance to win and leave ???

If Dad has been declared father in a court proceeding, you were not allowed to leave without a court order. If he has never been declared the father, then he has no rights,. If he is seeking to be declared the father and accept all that that entails, then you have to show the court why should be allowed to leave. The mere fact that he does not pay child support may not be enough top allow you to leave. Is it for a job, a new husband, or merely just to move out of state. You have to show the court why it should allow you to leave.
