Legal Question in Family Law in Illinois

My son is 8 years old and the guy that signed the voluntary acknowledgement papers at the hospital and was told not to knowing he wasn't the father then got a DNA test done and it even showed he was not the father he has not been in my sons life at all my finance has taken care of my son for the past 7 1/2 years and that is who my son calls dad well public aide went after the guy that signed the paper at hospital for child support and he now after 8 years has to pay so he wasn't visitation with my child can i stop that and also take his name off birth certificate?

Hello. It will be necessary to undo what was done. The public aid process is considered an administrative proceeding. On the other hand, in my opinion, filing a complaint in Circuit Court to determine that this gentleman is not your son's biological father is the correct approach. In my 26+ years of practice I represented an adult male in this manner before and we won. However, I strongly urge you to get a lawyer.
