Legal Question in Family Law in Illinois

My sons father and I have been together for 8 years. He started seeing a young girl from work before we were officially seperated. 2 weeks after we split he had her pregnant, but she lost it. This girl has a history of mental issues and has hurt herself over past boyfriends. My ex and her are planning on moving in together soon, my son has never met her. Keep in mind, it's only been a couple months since our seperation. He now wants joint custody of our son. I don't want my son around this girl, let alone live with her. What are the chances the judge would allow this?

It really depends on the severity of this persons mental issues and what you can prove. It is hard to prove that a person has harm herself in the past without obtaining medical records. You would have to file a petition for custody and a judge would consider what the best interest of the child is. Part of that consideration includes people that the child would be exposed to. It may be possible to limit the Child's interaction with this person if a judge determined it was in the best interest of the child, but I'd need to know more about your case.
