in the state of illinois, if a non-custodial parent is unemployed but is married to someone who is, is the employed party obligated to pay child support?

Hello. My answer is no. It is quite probable that the unemployed non-custodial parent will be ordered to appear in court every thirty days with a job diary. This allows the court to determine whether the unemployed parent is actually seeking employment. However, the spouse of the unemployed parent is not liable for the child support.
