Legal Question in Family Law in Illinois
i have been taking care of my great nephew for 8 months, his mother, who has full custody, is now willing to give me guardianship of him and we are wondering if we need the child's father's permission in order to do so. the father has a history of abuse and currently has an order of protection against him in effect preventing him from seeing the child or the mother or myself. can the child's mother and i go to court without the father?

father is entitled to notice of the guardianship proceeding and has a preference for custody.
