Legal Question in Medical Leave in Illinois

My husband is scheduled to have surgery and his company does not have sick days and his vacation is a month away from the surgery. Can he get his regular paycheck under FMLA?

FMLA entitles a qualified employee to UNPAID time off. Your husband should try to speak to the employer to see if they will advance himm vacation time. The other option is to file for unemployment benefits for the period of time he is not able to work.
