Legal Question in Medical Leave in Illinois

i live in illinois and my hire date was 6/19/07. My termination date was 10/05/09.

I was terminated while i was on intermitted FMLA. I sent a written request for my employee file

and i was denied due to the fact that HR says i have not been employed with them for 1 year or more? Is this legal? And now what do i do?

You're enttiled to review your personnel file if you are a current employee or former employee with a request made within one year of having been employed with employer. We are happy to speak with you regarding your issue. You are facing a statute of limitations issue on the FMLA filing (2 years from the date of the adverse action).
