Legal Question in Medical Leave in Illinois
i work for the u.s postal service i have been approved for fmla since 1-4-10.I didn't recieve my approval in the mail until 4-2-2010 that stated i was fmla protected since 1-4-2010. On 4-19-2010 I called in and requested fmla protection for my existing illiness not a new case but the existing one,On 6-4-2010 I was issued a 14 day suspenion for my existing approved fmla condition.they say it was disapproved be cause the computer issued me a new case #.I only have one case on file and that is what I called in for.I RECIEVED A LETTER 5-27--2010 STATING THAT THE FMLA I REQUESTED WAS DENIED BECAUSE MY SERVCIES WERE NEEDED AND THERE WAS NO SUCH CASE NUMBER I WAS VERY SICK AND LIGHTHEADED SO I COULDNT WALK DOWN STAIRS TO GET MY CASE NUMBER BUT I SAID DURING THIS CONVERSATION THAT THE CALL IN WAS A EXISTING CASE THAT I HAD BEEN APPROVED FOR SINCE 1-O4-2010 CAN YOU SHOW ME HOW TO FIGHT BACK

FMLA is very technical. I know with the USPS they do open "new cases" in a manner that can confuse even the most savvy employee. I would fight back by creating a written timeline of the events and each case. Outline the facts so that you can speak fm an informed point of view when you complain for what sounds like interference with your FMLA rights.
