Legal Question in Civil Litigation in Illinois

My daughter was sexually abused by a teacher and the case is still ongoing. She has been hospitalized for mental reasons and suicidal thoughts. Do I have the right to sue the suspect for mental damages? I've been told that it would be costly and not worth my time.

It will be costly because you will have to pay for attorney fees. I am not sure many attorneys will take on this case on a contingency basis, since, the teacher 1) probably does not have an estate worth much and 2) his bankruptcy will, in a blink of an eye, discharge it any and all judgments you may get against him. So, either way, not many attorneys will want to invest in such a situation.

How horrible! It is literally impossible to get past a betrayal in someone you trust with the safety of your child.
