I purchased a salad from Wendys and about halfway through eating it I found a piece of hard plastic that was creased in half, about 2-3 inches long and about 1/2'' wide when folded in half and inside this piece of plastic was what looked like dirt. I contacted Wendys main office and they did call me back and filled out a insurance report over the phone and said that I would receive a phone call from their insurance adjuster from Gallagher & Bassett. What are they going to cover? My main concern is what was on that plastic that I may have ingested. Do I have case to do anything about this?

What is your injury from this event?
The law does not cover what "may" have happened. It covers only what "did" happen.
There is negligence on the part of Wendys. But, how did that negligence injure you? And how have you documented that injury?
If you have not been sick, or have not been to the doctor, you have no case for a personal injury.
You may get a couple of hundred dollars for your trouble, but that would be about it.
Unless you can show injury.

Unless you are significantly injured there is no case worth bringing in anything other than on your own in small claims court. Without serious injury the case is not worth much.
