Legal Question in Civil Litigation in Illinois

Motion for a continuance on somebody else's motion hearing

The other party in a lawsuit has filed a motion (hearing is next week).

Unfortunately I cannot attend but I would like to.

Can I file a motion for a continuance so that the hearing is postponed?

How important is to attend a motion hearing?

Re: Motion for a continuance on somebody else's motion hearing

This is why you need a lawyer. No one can appear in court on your behalf except for you or an attorney.

You can make an agreement with the other party in the case to continue the motion, but if they can't your rights will be affected. You may lose the case.

Re: Motion for a continuance on somebody else's motion hearing

It is important not to just blow off a motion hearing. Depending on the kind of motion it is, substantive discussion, even a court ruling, could occur. You may be able to reach an agreement with the other side to reschedule the motion. If not, and you can't rearrange your schedule to attend, you should request that the court reschedule it. But be prepared to tell the court a good reason why you cannot attend. The court may not view many things as more important than its proceedings.
