Legal Question in Civil Litigation in Illinois

I think my question was misunderstood. I moved into an apartment complex that had water damage, which I was told was fixed. A month later I started having mold and mildew problems on my shoes and baseboard. Management called a cleaning company who verified that it was mold/mildew. A month later mold was on furniture and I was having a hard time breathing. It was verified from the city and health dept that this was a problem. I contact management and they did nothing else about it. I was told that my lease would be broken and I can move. I asked that my damages be paid which I was told no. There was a preexisting problem which they knew about and did nothing further. In the lease it said if there was willful neglect the owner was responsible for a tenants damage. Are there cases where a matter similar was won in court?

There have been both property damage and personal injury cases won over mold. Personal injury cases are particularly difficult because of uncertain medical science. Property damage claims tend to be more routine, contract issues.
