Without knowing a lot more about the case, no one can tell you whether it�s safe to apply for a green card. However, it�s certainly not safe to remain out of status and in limbo. Furthermore, an age difference is not grounds, in itself, for denial of an application for permanent residence, and if your marriage is bona fide then you definitely should not let the age difference dissuade you from regaining legal status (and getting employment authorization, a driver�s license, etc.).

Although, the info you provided appear to indicate this is a bona fide marriage, however, an exhaustive consultation would provide you with better answer. The last two sentences of your question reveal that there is a bona fide marriage in existence here but, I will like to know more about you just to be sure there are no other grounds to disqualify you. Age difference between you and your spouse, in itself, will not prevent you from securing a green card.
