Legal Question in Immigration Law in Illinois

Green card decision

Hi,

I am married to a U.S citizen. I came to U.S on J1 and my waiver was approved. Would it be safe for me to file for green card, although the age gap between me and my spouse is 37 years? We love each-other, live together, dine out together, have bills, medical insurance, and lease under both names. We met each-other three years ago, and lived together since then. Do I have any good chances to get the green card, although there is an age gap? Thank you.

Re: Green card decision

Without knowing a lot more about the case, no one can tell you whether its safe to apply for a green card. However, its certainly not safe to remain out of status and in limbo. Furthermore, an age difference is not grounds, in itself, for denial of an application for permanent residence, and if your marriage is bona fide then you definitely should not let the age difference dissuade you from regaining legal status (and getting employment authorization, a drivers license, etc.).

Feel free to contact me to discuss your case 708.383.2103.

Best wishes,

Re: Green card decision

Although, the info you provided appear to indicate this is a bona fide marriage, however, an exhaustive consultation would provide you with better answer. The last two sentences of your question reveal that there is a bona fide marriage in existence here but, I will like to know more about you just to be sure there are no other grounds to disqualify you. Age difference between you and your spouse, in itself, will not prevent you from securing a green card. If you need to know more, I will suggest you contact my office at 217-787-2346 (for Springfield, Il area) or 312-214-3290 (for Chicago office). A brief visit to my website: http://www.omolaws.com may be of interest to you as well where you may even initiate further contact with my office. Good luck.
