Legal Question in Immigration Law in Illinois

I am married to an american citizen. Three years a go we went for our first interview where the immigration officer requested more evidence. We sent in every piece of document that was requested. Since then me and my husband has separated due to him becoming abusive. Last year I received a deportation letter from immigration with no reason as to why i am being deported. They included an additional letter stating I can request an appeal if I felt that they had made an error in their decision ton deny my case. My husband being quite aware of the reasons we separated file a motion to appeal. I have sinced a had baby with someone else who wants to marry me. I wanted to if I divorced my husband what would be the first step in filing my papers? Will I have to go back to my native country? Please help i'm so lost.

If you were ordered deported, you will need to reopen your case in Immigration Court before you can think about any other ways to stay in USA.

If the I-485 was denied 3 or 1 years ago, you must have received the denial letter. If an appeal was filed, you need to follow up with the pending appeal.

Your first step should be consulting a good immigration lawyer. You should keep in mind that marriage to another US citizen by itself doesn't provide protection from deportation.
