Legal Question in Intellectual Property in Illinois
foriegn patents
Dear Sirs:
If a patent is issued in Italy for a specific scientific test/application, does that patent apply in the US? A scientist in Italy says he has patented a technique to determine the age of wood in art objects (frames, wood scultures etc.) using a spectroscopic analysis. If I was able to recreate his experiments and develop and comparable method, then use it in my business would zi be infringing on his patent?

Re: foreign patents
It depends. If it only is patented in Italy then it does not apply to use in the USA. However, most manufacturers will file applications in most major jurisdictions to get complete coverage. I cannot be more specific, however, since I don't know the specifics of your situation.
