Legal Question in Intellectual Property in Illinois

if a publishing company mistakenly forwards royalties over a period of years to another writer with a similar name as mine, and if that writer knowingly cashes those checks after reviewing a statement that lists songs that are not his, has that writer committed theft an should this matter be referred to law enforcement?

I would suggest contacting your PRO first. I cannot imagine that this is the first time this has happened, and they may have a mechanism to remedy it somehow.
