Legal Question in Employment Law in Illinois
I am 4 months pregnant and I am being pressured at work regarding my return. My manager keeps asking me if I plan on returning to work after I have my baby. An ad for my job was placed on Craigslist by my manager on 3/19/10. They plan on calling applicants 3/29/10 to schedule interviews. I feel very pressured and stressed at work. I feel as if they are pushing me out of my job. I've had 2 miscarriages in the last year and my manager is well aware of them. I am a very good employee, have been employee of the month in the past and have been nominated many times for employee of the month. I have had excellent reviews also. I feel that what they are doing to me isvery unfair and I just want to know what my rights as an employee are. Honestly I do not need this pressure/stress right now, I'm just trying to make sure this pregnancy is safe.

I'm not clear on whether you are currently on leave. Also, are you eligible for leave pursuant to the FMLA? Complications frm pregnancy are one grounds for taking FMLA. As a basic principle, your employer is entitled to be able to make arrangements to cover your work during your absence. One example is hiring a temporary employee to handle your duties while you are on leave. However, pressuring you to decide if you will return to work following your pregnancy and placing an ad for your job could be viewed as discrimination because of your pregnancy. Determing if you are experiencing pregnancy discriminaiton is very fact specific. I am happy to help you with this determination. Please contact me.
