Legal Question in Employment Law in Illinois
On April 11, 2013, I was called to a meeting with HR and my boss. At that time, I was told that my attitude and demeanor was detrimental to a meeting that I had been in earlier that morning. They informed me that I was also just not meeting their leadership standards, or growing in my position as they had hoped. The meeting was very short, and I was completely blindsided. They told me that they would discuss my position and meet with me the following week. I had no idea. I left the meeting very upset and later that day asked for a writen outline of what was discussed at the meeting, examples of how I was not meeting standards, and copies of my reviews. During the following week I exchanged emails with HR, because that is all that would reply, asking when we would meet again. Monday I was told my boss was out sick and they would let me know. Tuesday I was told again my boss was out sick, and they would let me know. Finally Wednesday I was told my boss would be out the rest of the week, and they would follow up with me the next week. On Monday, I was told, not by my boss or HR, but by one of my co-workers, that they had talked to my boss and that he informed them that they could notify me that my job was "ok". On Wednesday of this week, April 24, 2013 I was told that a patient had complained about me, and was asked about it. I was asked a few questions about this (it was reguarding a patient getting an appointment), and I gave my honest answers. Finally this morning, I was called into the office and told that I was being suspended with pay while they investigate the complaint. I was told very little, just that they would be in contact with me and that I was not to contact anyone employeed by the hospital that I work for. I ask why there had been no response to my first email about examples, and my reviews, and the answer I was given was that they were working on a write up, and that my reviews had nothing to do with this. I was then escorted to get my purse and then to my car.
What should I expect now? How long can this go on? Should I have someone with me when they review what is determined from the investigation? Who do they talk to during this investigation, and how do I know that they are talking to all the people involved? Do I have to sign paperwork about this if I don't agree with the outcome? If they terminate me can i apply for unemployment, how will it effect future job chances, and what am I allowed to leave with?
