Legal Question in Employment Law in Illinois

I am a dental hygienist and my boss has held our paychecks past payday 2 times in the last month and a half. He said that he does not have the funds in the accounts to cover our pay both times. Do we have any legal action we can take if he does not pay us or pay us on time?

If we don't get paid can we collect unemployment? I live in IL.

This practice violates Illinois law. Under Illinois' wage act, your employer is required to notify you of its pay days and the wages must be available on that pay date. If you have to take action to collect the wages, and you prevail, you are entitled to attorney fees and a penalty against employer.
