can i be required to submit to a drug test

Hello. If the employee operates machinery or transports passengers, the employer may be able to justify a random drug testing process. The employee can always refuse, but might jeopardize his or her job. It depends upon the type of job and the extent to which the testing can be justified as a means to safeguard the public. Also, politics may play a role. For example, in

the county where I practice law, judges and lawyers are not required to submit to drug testing. On the other hand, deputies at the County Jail must walk into and stand in a testing device along with the general public. This device

is designed to detect the presence of tabacco and alcohol on persons entering the jail complex. These substances are considered contraband and the person testing positive is denied entry and according to the signs, may be criminally prosecuted.
