Im an exempted salary employee and i would have to leave the state for about two weeks because of the birth of my baby as my wife moved back to our natal State, do i still get pay and excused by my empoyer?

Under the family medical,leave act, if you are an eligible employee, you get up to 12 weeks leave for the birth of a child. There is no requirement this leave be paid, however. But your employer is required to restore you to your job prior to the leave. If you have any accrued sick or vacation time you should be allowed to use it. To be an eligible employee you must have worked for an employer employing 50 or more employees for one year and 1250 hours. You must follow your company's procedures for use for foreseeable FMLA.
