Legal Question in Employment Law in Illinois

My Fiance was suppose to be on medical leave from work!Now he is an assistant manager of this company and his GM is still having him work. He has worked everyday that he was suppose to be off.Wanted to know what can be done about this!

Is your fiance on leave protected under the FMLA or is the leave a form of reasonable accommodation under the ADA. IN either case, your fiance should not be at work if his doctor has certified that it is medically necessary for him tonot work. By continuing to work he could be proving that he is medically able to work.
