I am currently on FMLA approved/eligible maternity leave. I go back to work in a few week. My company is in the process of downsizing, can they eliminate my position an lay me off the day I return to work? Am

I only protected while on leave?

Being on FMLA leave does not protect you against actions such as lay-off etc if the decision to select you for lay-off is legitimate and not because you are on protected leave.
