Legal Question in Employment Law in Illinois

I was laid off a few months ago. I saw an ad for my job about 2 months later. When I called the company to see about this, they denied the ad was for my old job. I have since confirmed that they hired a much younger person from outside the company to take my job. Do I have any recourse?

Just because someone is much younger doesn't qualify as age discrimination. Part of proving such a case requires that you prove you are in the protected age class (40 and over). Additionally, companies routinely reorganize and although a job might look like your old job, it might legitimately be a new job. On the other hand, your former employer might be trying to pull a fast one and has simply repackaged your job as something else to defend against a claim for age discrimination.
