Legal Question in Employment Law in Illinois
Hello Lawyer,
My name is Mira . I'm representing my husband. My husband got terminated from his current employer because he refused to be transferred to other state (without any early notification from the employer) . He never been told that he will be transferred to other state until last sunday ( and he has to go to other state today - wed 06/01/2011) and he refused to be transferred. He has the strong reason not to be transferred since they never had any paper agreement and he never wanted to be transferred to other state but the employer denied so, and mentioned they had the oral agreement before (but I swear they never had before). For this case, if we would like to sue the employer could we win the case?

First, under the circumstances you describe, your husband should be apply for and receive unemployment benefits.
Second, bringing action against the employer depends entirely upon any agreements that might be in place. In Illinois, an employer can terminate an employee for any reason or no reason, with or without notice, and not be on the hook for wrongful termination, unless the termination violated an agreement or was in violation of various laws (such as terminating someone for their religious practices or being pregnant etc). I hope this helps. Good luck.
