Legal Question in Employment Law in Illinois
I live in illinois and have been trying to get back pay for when I was on fmla. My HR manager has dragged her feet for over a month to resolve this issue, and made comments to my manager, that I am only trying to get this back pay because I can not control my finances. This has caused me many hours off of the sales, at a job that pays commission, as well as upset me to the point I have been getting migrane headaches and having to leave work. This has caused me to have the worsted sales commission since I have worked there in three years, also affecting my income. I have also seen changes to pay role, for the time I was off that do not match my pay stubs. This all makes me feel very unwelcome at my place of employment. Is there any legal action I can take to resolve this, or to get any compinsation?

If you are entitled to backpay because the backpay is wages, your employer is required to pay this. I am not aware of any law that allows for "emotional distress" damages for unpaid wages, however.
