Legal Question in Employment Law in Illinois

How long can an employer take to let you know if your FMLA was approved or denied. I have been told not to come to work and have been wating two weeks already in order to hear word on if I am actually approved for FMLA or not. I am not getting paid during this time. Is there a law that states they have to let me know in 7 days or some type of timeframe or can they just keep me on hold for as long as they want to

Your employer can take its time (unfortunately) with the new FMLA regulations that went into effect in 2009. However, your employer cannot allow you to believe you are on approved FMLA and then tell you the absence was not FMLA thus unexcused. Also, FMLA is an unpaid leave. But your employer can opt to allow you to receive sick pay or other paid benefits.
