State of Illinois: Labor Question

Company selling - senior management employee (VP) has been advised that no exit packages are required by law, but precident has been set with a lower level employee being given a substantial exit package. Because a precedent has been set, does the VP have rights to a similar if not better exit package?

Arriving at the right answer requires an analysis of different factors. Bottom line is that though it is true that severance is not required by law, an employer making a practice out of paying severance to some employees can find itself legally obligated to do so with all employees. You mention only one employee. That likely does not rise to the level of a practice. You also mention that you are an excutive level employee which could preclude you from ordinary severance even if a practice is found to exist. You should consider consulting with an experienced employment attorney to advise you of your full rights.
