Legal Question in Employment Law in Illinois
I am a teacher and was mandated to take a drug test at work last week upon leaving early for a doctors appointment. My principal and assistant principal escorted me into the office and read me a formal letter that stated I must take the test or it is grounds for automatic termination. I called the union and called my mother, a long time teacher. The asssistant principal then walked me through the halls to the teachers lounge where we waited for the test administer. We were then called by the PA system to return to the office where I was escorted into the principals office to meet with the nurse. He conducted a breathalyzer and urine test. He left the room to make a copy of my photo ID and then I walked out the office with him where students and personel were standing. I did not find this to be confidential or private in any way. This situation has caused me deep stress and anxiety, even though the test was negative. do I have and legal rights?

If your employer can articulate reasonable grounds for the drug test, I think you are out of luck. You should seek recourse with your union about how the testing was handled. See if the process is outlined in the collective bargaining agreement. If there is a violation of the CBA then you should have valid grounds for filing a grievance.
