Legal Question in Employment Law in Illinois
My wife is a salaried employee and continuously works 11hr days with no allocated time for breaks. Is this legal?

Being paid a salary does not necessary make an employee exempt from breaks and overtime. An employee who is not exempt must be given an appropriate work-free meal period and paid overtime for those hours worked over 40 each workweek. The calculation of this overtime for a salaried employee is a little different than for an hourly employee. Please consult with a qualified wage and hour attorney.
