What is the statute of limitations on medical malpractice for a botched back surgery

Generally there is a two years statute of limitation on any injury cases in Illinois. Under some circumstances the statute can be 4 years--but that depends on the facts of the case and the time when you became aware of the possible cause of action.

As a general rule - and only as a general rule - you have two years from when you SHOULD have known of the malpractice to file a lawsuit.

However, there are many variables which may shorten or lenghten that time.

Among them are that the victim of the malpractice was a minor, that the malpractice was actively concealed, etc.

Therefore the only way to accurately answer your question is to sit down face-to-face and go over every possibility.
