moms hospital care

My mom passed at a hospital near us ,

she went in for a liver biopsy and her liver was sliced and she bled to death,she passed 24 hours after, what can be done?

You have to file a lawsuit within two years of the date you should have known of the negligence.

Before you can file that lawsuit, you need to have another doctor review the records and provide an affidavit that the appropriate standard of care was breached and that the death resulted from that breach.

In this instance, the best way to begin is to order the medical records from the hospital, insist upon an autopsy and contact my office for an appointment.

You must move quickly and get an autopsy done so as to determine the exact cause of death. We then have to review the entire medical records in order to find out whether the doctors, nurses and hospital failed to follow the standard of care that is expected of them. If so, we'll file a lawsuit immediately and move forward that way.

Do your research and go with the law firm that you most feel comfortable. Ask questions about cases they have handled in the past.

My condolences to your family. A routine procedure should not end in tragedy.

I agree with the other counsel that you must obtian an autopsey as soon as possible.

However, there is no such thing as a routine medical malpractice case, nor do attorneys take on medical malpractice cases on a "routine basis". I would be interested in knowing why your mother was in for a liver biopsy. I would also be interested in knowing what the informed consent form states, what the doctor told your mother before the biopsy and what he told you afterwards.

I would welcome the opportunity to help your family sort this situation out. My practice is to personally consult with the victim's family at their home where they are most comfortable. I have found that doing so usually gives me a better understanding than I can get in a sterile office environment.
