You must go into the details. In order to answer your inquiry I need a LOT more information than you have provided. Simply a hunch or your belief that the doctor committed malpractice is not enough to file a malpractice suit.

1- what year your mother passed?

2- What was the date of last visit by any doctor before your mother pass?

3- do you have the entire medical records from the first day your mother was seen by the doctor to the last time any doctor saw your mother? If not, you will have to get them. In Illinois, in order to file a claim of malpractice, an expert must review the entire medical records and then sign an affidavit saying that he has reviewed the medical records, that he is knowledgeable, and that in his opinion the doctor failed to follow the standard of care. Without this affidavit from an expert, your case will simply be dismissed.

So in order to find out whether or not malpractice occurred, we must do some leg work first.
